At Starr Attorneys, we are committed to transparency and fairness in all our financial dealings with clients. This Refund Policy outlines the terms governing refunds related to overpayments and termination of legal services. By engaging our services, you agree to the terms set forth herein.
1. Overpayment Refunds
In the event that a client makes a payment exceeding the amount due for any legal service or invoice, Starr Attorneys will promptly acknowledge the overpayment.
Clients may choose to:
a. Request a full refund of the excess amount; or
b. Authorize Starr Attorneys to hold the overpaid amount as credit, which can be applied towards future legal services or invoices.
Refunds for overpayments will be processed within 14 business days upon receipt of a written refund request or confirmation of credit instructions from the client.
Refunds will be made using the original payment method unless otherwise agreed.
Where no instruction is received from the client within 90 days of the overpayment being identified, Starr Attorneys reserves the right to hold the overpaid amount as credit for future use.
2. Termination and Pro Rata Refunds
Either party may terminate the engagement of legal services by providing written notice to the other party.
Upon termination, the client will be invoiced for all services rendered and disbursements incurred up to the date of termination.
Any retainer fees or advance payments made for future services beyond the termination date will be refunded on a pro rata basis, calculated based on the portion of the services not yet rendered.
Pro rata refunds will be processed within 30 days of termination and issuance of a final statement of account.
In cases where services have been substantially rendered or where termination occurs due to client’s breach or misconduct, Starr Attorneys reserves the right to withhold any applicable refund as permitted by Nigerian law.
3. General Provisions
All refund calculations will be conducted fairly and in accordance with applicable Nigerian laws and regulations governing legal practice and client funds management.
Starr Attorneys reserves the right to amend this Refund Policy at any time. Clients will be notified of any material changes through the contact details provided.
This Refund Policy is without prejudice to any other rights or remedies available to either party under the engagement agreement or Nigerian law.
